CoComply perform online and in-person IR35 assessments with each contractor manager and contractor. After the initial assessment and as the IR35 maturity of your business increases you can opt to undergo online form based re-assessments.
The IR35 assessment also includes a review of the relevant Statement of Work or Assignment Schedule.
CoComply will issue the Status Determination Statement (SDS) to the client, contractor and any fee-payer, once the IR35 assessment has been completed with both the contractor manager and contractor.
The initial assessment with the contractor manager takes around 30 minutes. Contractor assessments, reassessments and check-ins typically take between 15 and 20 minutes.
We recommend undertaking a compliance check-in with the contractor manager and/or contractor, 3 months after the initial assessment, to gather evidence to support the original determination or to identify if the engagement has not materialised as initially expected.
In most cases, reassessments with the contractor manager and contractor should occur on a 6 month basis, but may be done more or less frequently (3 months or 12 months) depending on the risk profile of the role.
Yes, CoComply provides advice and guidance on how contracts and working practices can be restructured to demonstrate an outside IR35 engagement.
Yes, similar rules apply to sole traders; therefore, we also assess their status.
The CoComply contractor identification audit identifies in-scope contractors/PSC’s from various talent/supplier channels. Often there are hidden PSC’s via procurement and other supplier channels, and we will review these suppliers in order to identify those that constitute a PSC and must be reviewed in order to determine IR35 status.
Once we have assisted in assessing all your off-payroll workers, CoComply can provide you with data, information and reports to aid in any request for information from HMRC.
The CoComply training portal offers you access to training courses related to IR35 and engaging with off-payroll workers. We have sessions tailored to specific roles within your organisation (HR, procurement and contractor managers etc) as well as you having the option to request tailored training sessions specific to your organisation factoring in your internal process. The sessions can be recorded and slide deck and corresponding documentation circulated after the session.
